Brake Drums: Preliminary Dumping Rates Revealed

The U.S. Department of Commerce has issued preliminary affirmative determinations in the antidumping duty (AD) investigations of certain brake drums originating from China and Türkiye. These findings, announced on January 24, 2025, address allegations of unfair pricing and follow concurrent countervailing duty (CVD) investigations. Under these preliminary determinations, Commerce has assigned various dumping rates to exporters and producers in both countries, reflecting the agency’s assessment of the extent to which brake drums may have been sold in the United States at less than fair value.

These determinations follow a timeline that began with petitions filed on June 20, 2024, and subsequent initiation by Commerce on July 10, 2024. The International Trade Commission (ITC) made its preliminary determinations on August 12, 2024, paving the way for Commerce’s current preliminary AD determinations on January 23, 2025. Final determinations are expected by June 16, 2025, although these deadlines can be extended under certain circumstances as dictated by sections 733(b) and 735(a) of the Tariff Act of 1930, as amended.

Should Commerce and the ITC both make final affirmative determinations, antidumping duty orders may be issued as early as August 7, 2025. These orders would then require U.S. Customs and Border Protection to impose duties on imports of brake drums within the scope of the investigations. Given the trade impact, all interested parties are advised to consult the case record on Enforcement and Compliance’s Antidumping and Countervailing Duty Centralized Electronic Service System (ACCESS) under case numbers A-570-174 and A-489-853.

Commerce, as of now, maintains 721 AD and CVD orders to safeguard American businesses against unfair international trade practices. These decisions underscore the Department’s continued focus on ensuring a level playing field for U.S. industries.
